Supreme Court to hear Prop 8 and DOMA cases this week

On March 26, 2013, the Supreme Court will hear argument in the case of Hollingsworth v. Perry, popularly known as the California “Prop 8” case. Proposition 8, a ballot proposition passed by voters in a 2008 state election, purports to amend the California constitution to restrict marriage to heterosexual couples.

On March 27, 2013, the Court will hear Windsor v. United States, more commonly known as the case against “DOMA,” or, the federal Defense of Marriage Act. DOMA likewise sought to effectively restrict marriage between homosexual couples. Section Three of DOMA prevents the federal government from recognizing any marriages between gay or lesbian couples for the purpose of federal laws or programs, even if those couples are considered legally married by their home state. This Section is being assailed as violative of the “equal protection” clause of the United States Constitution.

The decision on the cases will be issued likely at the end of the Court’s term in late June, 2013.
